A home care agency cannot make Dad eligible for Aid and Attendance. It can, however, make the expense side of his pension claim easier or harder to prove. Before signing, ask each agency for a sample service plan, caregiver record, invoice, payment receipt, and year-end statement. Compare what those documents identify, not how confidently the salesperson says the care is covered.
First, test the three gates
Aid and Attendance is an increased VA pension amount, not a separate program that automatically pays a home care bill. Dad first needs eligibility for Veterans Pension. Check qualifying wartime active service and discharge status, the age or disability requirement, and the household income and net worth limits. Service rules vary according to when active duty began, so compare the DD214 against VA's eligibility rules instead of relying on the word “veteran.” VA pension eligibility
Then test the medical gate. VA may find a need for regular aid and attendance when the claimant needs another person's help with daily activities, is bedridden, is in a nursing home because of incapacity, or meets VA's stated vision criteria. The evidence should describe dressing, feeding, toileting, cleanliness, mobility, safety, where Dad goes, and what he can do during a typical day. Finally, test the financial gate using the household, not Dad alone. VA considers family income and net worth. The pension payment is generally the difference between income for VA purposes and the applicable Maximum Annual Pension Rate. Certain unreimbursed medical expenses may reduce income for VA purposes, while asset transfers for less than fair market value can produce a penalty period. Give every agency the same comparison test
Ask each agency to show, in writing, who receives the care, who provides it, the service dates, the tasks performed, the amount charged, the amount paid, and any reimbursement or credit. VA Form 21P-8416 asks for the provider, purpose, person for whom the expense was paid, payment dates, amount paid, and reimbursement information. Put five questions to every provider: Will the care plan name the hands-on and supervisory tasks? Will visit records show which tasks actually occurred? Will invoices separate care from deposits, supplies, transportation, housekeeping, or other charges? Will receipts show what was paid rather than merely billed? Will the agency correct a record and provide a consolidated statement if VA asks? Keep the sample documents with the quote. The cheaper quote may be the poorer choice if nobody can later connect the payment to Dad, the provider, and the care.
Do not ask the agency to decide whether an expense is deductible. Ask it to document the transaction accurately. The forms by number
For Dad's initial pension claim, start with VA Form 21P-527EZ. For the increased Aid and Attendance amount, include VA Form 21-2680, Examination for Housebound Status or Permanent Need for Regular Aid and Attendance. A clinician completes the examination information, but the family should review whether it describes Dad's actual help with daily activities, mobility, safety, and typical day. If the file is not ready, VA Form 21-0966 is the intent to file. VA says it can secure the earliest possible effective date for retroactive benefits when the completed claim follows within the allowed one-year period. How long, and who carries the care bill
Do not let an agency build the care plan around a promised approval date. VA may request more evidence, and processing time depends on the file. Check claim status, open every VA letter promptly, calendar the response deadline printed in the letter, and keep proof of every submission. Care may start on private pay while the claim is pending, but the family should approve only hours it can fund without assuming when or whether VA will award pension.
If VA denies the claim or assigns an amount the family disputes, read the reasons and evidence list before choosing a response. VA provides three decision-review paths: a Supplemental Claim for new and relevant evidence, a Higher-Level Review when the asserted problem is an error and no new evidence is being submitted, or a Board Appeal. Who files it free
A VA-accredited Veterans Service Organization representative can help gather evidence, file the claim, and communicate with VA, and VA states that VSO representation on benefit claims is always free. Verify the representative in VA's accreditation search, ask whether the office handles needs-based pension claims, confirm who will review Forms 21P-527EZ, 21-2680, and 21P-8416, and ask how the office provides submission receipts. Use the right VA door
The St. Louis VA Regional Benefit Office is the benefits door. It assists with pensions, claim paperwork, records, and payment issues. The VA medical center is the health care door. A VA clinician may hold relevant medical records or complete clinical evidence, but the medical center does not replace the pension claim filed with the Veterans Benefits Administration. Survivors use a different application
If Dad has died, do not reuse his Veterans Pension application for Mom. A surviving spouse or eligible child applies for DIC, Survivors Pension, and accrued benefits with VA Form 21P-534EZ. That application can also request increased benefits based on the survivor's own need for Aid and Attendance or housebound status. Do not treat Medicaid as a footnote
Ask every facility who is paying, what portion remains Dad's responsibility, and when Medicaid coverage begins. VA instructions state that pension may be reduced to $90 per month when a beneficiary has no dependents and receives Medicaid-covered nursing home care. That rule concerns nursing home Medicaid, not every person receiving home care or every Medicaid program. The decision before signing
Choose the provider only after three files agree: the care plan says what Dad needs, the contract says what the agency will deliver and charge, and the sample records show how the family will prove what was delivered and paid. Put one person in charge of collecting monthly records and matching them to bank activity. The agency supplies care and records. The clinician supplies medical findings. The accredited representative helps assemble and file the claim. VA decides eligibility and the payment.
