Can VA Aid and Attendance pay a family member is the question after a daughter has already been doing the baths, the nights, and the meals. Short answer: the VA does not write a check to your sister. The pension, if it is approved, is cash paid to the Veteran or surviving spouse. They decide how to spend it. Whether a payment to a relative then counts on the expense report is a VSO documentation question.

Aid and Attendance or Housebound benefits are monthly payments added to a VA pension for qualified Veterans and survivors who need help with daily activities such as bathing, feeding, and dressing, or who are housebound. You cannot receive both add-ons at the same time. It is cash on a pension, if the file clears, not a voucher to an agency and not a check to a relative.

Can VA Aid and Attendance pay a family member who is already doing the care?

Do not hear "the VA writes a check to my daughter." Pension is paid to the Veteran or surviving spouse. They decide how to spend it. If the household later pays a daughter, a son, or a neighbor for attendant hours, that is a private arrangement. This desk will not invent a dollar figure for what a relative should be paid, and it will not tell you the arrangement is automatically allowed on the pension math.

Two questions get mixed. First: can the household use pension cash to pay someone already in the house? The cash, once it is his or hers, is theirs to spend. Second: will VA treat those payments as unreimbursed medical expenses? That question lives in 38 CFR 3.278. Take the actual arrangement to an accredited VSO. The pension itself still has to exist. Aid and Attendance is an add-on, not a substitute. VA's eligibility page is gate one and gate three. Gate two is need, documented on VA Form 21-2680, which an examining physician completes. A relative already doing the care does not skip those gates. Bring a one-page note of what he cannot do alone. Do not tell the doctor what to write.

From December 1, 2025, to November 30, 2026, the net worth limit to be eligible for Veterans Pension benefits is $163,699. Maximum Annual Pension Rates increased 2.8 percent effective December 1, 2025. For a Veteran with no dependents, VA lists MAPR of $17,441 without Housebound or Aid and Attendance, $21,313 with Housebound, and $29,093 with Aid and Attendance. A VSO runs his numbers from invoices, not from a story.

Do payments to a relative count as unreimbursed medical expenses?

Only if they actually are unreimbursed medical expenses under the regulation. 38 CFR 3.278 says payments for medical expenses must be unreimbursed to be deductible from income. If insurance, Medicare, Medicaid, or anyone else paid you back, it is not unreimbursed. Keep cancelled checks, transfers, and a simple hour log with dates, hours, who was there, and what was paid.

The regulation defines the work people argue about:

  • Activities of daily living (ADLs): bathing or showering, dressing, eating, toileting, transferring, and ambulating within the home.
  • Instrumental activities of daily living (IADLs): shopping, food preparation, housekeeping, laundering, managing finances, handling medications, using the telephone, and transportation for non-medical purposes.
  • Custodial care: regular assistance with two or more ADLs, or supervision because a person with a physical, mental, developmental, or cognitive disorder requires care on a regular basis to protect that person from hazards in daily life.

Paragraph (d)(2) is the attendant sentence. Payments for assistance with ADLs and IADLs by an in-home attendant are medical expenses as long as the attendant provides the disabled individual with health care or custodial care. Payments must be commensurate with the number of hours that the provider attends to the disabled person. The attendant must be a health care provider unless one of these is true:

  • The disabled individual needs Aid and Attendance or is housebound, or
  • A physician, physician assistant, certified nurse practitioner, or clinical nurse specialist states in writing that, due to a physical, mental, developmental, or cognitive disorder, the individual requires the health care or custodial care that the in-home attendant provides.

The regulation does not say "any relative, automatically." It says attendant, hours that match the pay, health care or custodial care, and either an Aid and Attendance or Housebound finding, a listed clinician's written statement, or a health care provider doing the work. VA Form 21P-8416, Medical Expense Report, is the page you use to report medical or dental expenses paid for yourself or a family member in the household that you were not reimbursed for. A VSO maps the regulation to the form.

The IRS is a different system. Topic 502 is a medical expense deduction only to the extent expenses exceed 7.5 percent of adjusted gross income. Do not mix that floor into a VA pension worksheet, and do not ask this desk whether paying a daughter is taxable to her.

Is the VA family caregiver program the same as Aid and Attendance?

No. If someone sells you the pension add-on as the program that "pays your daughter," they are mixing doors. The Program of Comprehensive Assistance for Family Caregivers is a separate VA health-care benefit. The Veteran must have a VA disability rating of 70 percent or higher, need at least 6 months of continuous in-person personal care services, and be enrolled in VA health care. An eligible Veteran may appoint 1 Primary Family Caregiver and up to 2 Secondary Family Caregivers. That is not Aid and Attendance.

VA St. Louis publishes a caregiver support page. The national Caregiver Support Line is 1-855-260-3274, Monday through Friday, 8 a.m. to 8 p.m. ET. Use it for caregiver-program questions. Use a VSO for the pension. A Homemaker and Home Health Aide is a trained person, supervised by a registered nurse, who comes to a Veteran's home to help with personal care and daily activities. Hiring an agency versus paying a relative

Some households keep the relative in the house and pay them. Some hire an agency so the relative can sleep or go to work. Neither choice is a VA staffing schedule. Medicare does not pay for 24-hour-a-day care at home, or for custodial or personal care when that is the only care needed. Missouri describes a private-pay door for aide personal care, respite, or companion care. VA tells you how to apply online, by upload, by mail, in person, or with an accredited representative. An intent to file can protect the effective date. None of that requires a paid consultant, and none of it requires you to put a relative on a payroll first.

What to do tonight

  1. Write down who is in the house, what they do, and whether any money already changes hands: dates, hours, amounts, who was paid. If nothing was paid, write that down too.
  2. Download a blank Form 21-2680 for the next appointment. Do not fill the medical findings.
  3. Download 21P-8416 from the 21P-527EZ family of forms.
  4. Call a VSO in the morning. Bring the hour log as it actually is. Do not transfer assets, sign an annuity, or pay a fee to file.

When to ask the care team or the doctor

Whether he needs regular help with bathing, dressing, feeding, or whether he is housebound, is a question for the physician who treats him. This desk does not decide it. The examining physician completes Form 21-2680. The written statement in 3.278(d)(2), if you need it, comes from a physician, physician assistant, certified nurse practitioner, or clinical nurse specialist. Ask the care team how they handle those letters. Do not draft one yourself. If he has fallen, if nights are newly unsafe, call the care team or the doctor.
