VA Aid and Attendance for a surviving spouse: home care on Dad's wartime service
VA Aid and Attendance surviving spouse home care is the search after the funeral, when the house is too quiet and Mom cannot manage the nights. His wartime service does not die with him. A Survivors Pension, with Aid and Attendance if she needs help with daily activities, is a real door. It is not automatic. It is a form, evidence, and a VSO.
VA says Aid and Attendance or Housebound benefits are monthly payments added to a VA pension for qualified Veterans and survivors who need help with daily activities such as bathing, feeding, and dressing, or who are housebound. Survivors is in that sentence on purpose. The add-on can sit on her pension, not only on his. It is still cash. It is still not a caregiver VA sends to Ballwin.
Can a surviving spouse get VA Aid and Attendance for home care?
If she qualifies for a Survivors Pension, and if she meets the need test for the add-on, yes: the household can receive a higher monthly pension and can spend it on help at home. That is not the same as VA staffing the house. It is not the same as DIC. DIC is a different benefit for deaths VA connects to service. Survivors Pension is needs-based and tied to wartime service and income. They share an application. They are not the same check. Do not let anyone tell you which one "pays more" as a kitchen-table fact. Open the VA pages with a VSO and look at her facts.
The wartime periods for survivors pension are the same list VA uses for Veterans: World War II, Korea, the two Vietnam lines, the Gulf War, and the earlier wars. VA prints them on the Survivors Pension page. If he served in Korea or in Vietnam, you are in the right century. You still need the DD214, the marriage evidence, and the income and net worth picture. What form does a surviving spouse file?
VA Form 21P-534EZ is the Application for DIC, Survivors Pension, and/or Accrued Benefits. VA's apply-online page says you can use that application for DIC, Survivors Pension, increased benefits based on Aid and Attendance or being housebound, accrued benefits, and benefits for a disabled child. One form, several boxes. A VSO will know which boxes to mark. You should not mark them based on a flyer.
VA lists four ways to apply for Survivors Pension: with an accredited attorney, claims agent, or VSO; online; by mail; or in person at a regional office. Mail, if you mail, goes to Department of Veterans Affairs, Pension Intake Center, PO Box 5365, Janesville, WI 53547-5365. The St. Louis regional office is on Page Avenue. The free local doors are on the VSO page. The Missouri Veterans Commission files survivor claims. The St. Louis County Veterans Program lists pension and DIC among the claims it assists with.
VA also asks whether you should submit an intent to file before the application. On the Survivors Pension page, VA says an intent to file can give you time to gather evidence while avoiding a later potential start date. Same logic as the Veteran's claim. Do not sit on the death certificate for six months with no intent on file.
What evidence does VA want for a Survivors Pension?
VA's evidence page, the section 5103 summary, says you will need to submit or give VA permission to gather the Veteran's DD214 or other separation documents, and the Veteran's death certificate, showing cause of death. If you are a surviving spouse, you also need your marriage certificate or other evidence showing you were married to the Veteran for at least 1 year immediately before their death. If you are claiming Aid and Attendance on her pension, the exam form is still 21-2680, completed by an examining physician. Bring it to her next appointment. Do not complete the medical findings. Unreimbursed medical expenses, including attendant care she pays for, go on 21P-8416. Keep invoices from the first week someone comes to the house.
Remarriage, length of marriage, and whether a later marriage ended are facts a VSO will walk. This desk will not invent the marriage rules. If the facts are messy, that is exactly why you do not use a consultant who leads with a product.
What to do tonight
- Put the death certificate, the marriage certificate, and his DD214 in one folder. If any piece is missing, write who has it.
- If she cannot be left alone tonight, cover the night. The form does not.
- Call a VSO in the morning. Say you need Survivors Pension with Aid and Attendance, Form 21P-534EZ, and you want an intent on file if the packet is not ready.
- Do not move her money, and do not pay a fee to file.
When to ask the care team or the doctor
Whether she needs regular help with bathing, dressing, feeding, or whether she is housebound, is a physician question. Grief, new falls, not eating, and nights that have gone unsafe belong with her doctor or the care team, not with a benefits consultant. If hospice is already in the house, ask the hospice nurse and the physician what they need from the family. Hospice is a Medicare benefit with its own team. This desk does not run it.
